1. Scope & Contracting Party

These Terms and Conditions apply to all orders placed via the online shop of Erbsland CREATIVE, Stöckackerstrasse 95, 3018 Bern, Switzerland.

By placing an order, you accept these Terms and Conditions.

2. Products & Custom-made Items

All products are made to order, e. g., using 3D printing from wood composite or plastic. Minor variations in color, shape, or texture are production-related and do not constitute a defect.

Images in the shop are for guidance; actual colors may vary depending on your screen.

3. Ordering, Conclusion of Contract & Cancellation

By submitting an order, you make a binding offer to purchase. You will receive an order confirmation by email; the contract is concluded with this confirmation.

Since the products are made individually, cancellation after production has begun is generally not possible (Art. 40c OR).

Cancellations before production begins are usually possible free of charge after contacting us by email. Once manufacturing or preparation has started, a proportional cost contribution may apply depending on the effort (e. g., for materials already used or design work). Please contact us as soon as possible if you wish to cancel an order.

4. Prices & Payment

All prices are in CHF, excluding VAT (not subject to VAT under Art. 10 MWSTG).

Payment is made via the payment methods offered in the shop and must be completed in full before production starts.

5. Shipping & Customs

Shipments are sent from Switzerland by post.

Deliveries within Switzerland: Shipping costs are shown during checkout.
Deliveries to the EU: Shipping costs are shown during checkout. Delivery times may vary depending on customs clearance. Customs duties are included in the shipping costs and covered by us. In rare cases you may incur additional costs - please contact us in such cases - we will certainly find a solution.

Once the parcel has been handed over to the carrier, the risk passes to you.

6. Withdrawal & Returns

As all products are individually made, there is no statutory right of withdrawal or return, unless there is a production error or an incorrect delivery.

Regardless of this, we voluntarily grant a 5-day return window (Goodwill) under certain conditions. Details can be found on the page Refund policy.

In case of production defects or incorrect deliveries, please contact us within 5 days of receipt by email at info@erbsland.com with a photo of the defect. We will review the case and offer an appropriate solution (replacement or refund).

7. Liability & Warranty

For defects, the provisions of the Swiss Code of Obligations apply (Art. 197 et seq. OR).

We are liable only for damage caused by gross negligence or intent. Liability for consequential damages, lost profits, or indirect damages is excluded.

No claims exist in cases of improper use (e. g., incorrect cleaning, weather exposure).

8. Privacy

We use your data solely to process your order and in accordance with our Privacy Policy.

The shop is operated on Shopify. In doing so, data may be transferred to servers outside Switzerland. For more information, see Shopify’s privacy policy.
